Terms and Conditions (Ts and Cs)

These Terms and Conditions ("Terms") govern your access to and use of services, products, and websites provided by FOTADE Group, which includes the following subsidiaries:

• FOTADE Global Consults (Education, Training, Research, Resource Development, Business Consulting, Investments, Communication Links)
• FOTADE Travels and Tours
• FOTADE Creations
• FOTADE Projects

By engaging with any service or offering from FOTADE Group or its subsidiaries, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Definitions

   FOTADE Group ("we", "our", or "us") values your privacy and is committed to protecting the personal information of our clients, partners and website visitors. This Privacy Policy outlines how we collect, use, disclose and safeguard your data when you interact with any of the following companies under the FOTADE Group umbrella:

   • "FOTADE Group" refers to the collective group of companies listed above.
   • "Client," "you," or "user" refers to any individual or entity accessing our services.
   • "Service" or "Services" refers to all products, consultations, travel bookings, training, or other offerings provided by FOTADE Group.
2. Scope of Services

   Each subsidiary offers specific services:

   • FOTADE Global Consults: Educational Training, Resource Development, Business Consulting, Research, Investment Advisory and Communication Services.
   • FOTADE Travels and Tours: Travel Planning, Visa Advisory, Tour Packaging, Ticketing (Flight), Accommodation Bookings and related services.
   • FOTADE Creations: Creative and design services including branding, multimedia content digital production and related services.
   • FOTADE Projects: Project management, development execution, and specialized consultancy in infrastructure or innovation and related services.
3. Eligibility

   To access our services, you must:

   • Be at least 18 years old (or have legal capacity);
   • Provide accurate and complete information when requested;
   • Not use the services for any unlawful or unauthorized purpose.
4. Payment Terms
   • All payments must be made in full before the provision of services unless otherwise agreed in writing.
   • Accepted payment methods include bank transfer, card payments and other options as communicated.
   • Late payments may incur additional charges or service delays.
5. Cancellation & Refund Policy
   • Training and Events: Refunds are subject to cancellation notice of at least 7 days prior to event date. After this, only partial refunds (up to 50%) may be issued.
   • Travel Services: Refunds are subject to airline and third-party policies. FOTADE is not liable for non-refundable tickets or fees.
   • Consulting Projects: Cancellations made within 3 business days of commencement may incur a penalty.
   • Creations/Design Work: Deposits are non-refundable after commencement of the project.
6. Client Responsibilities
   • Provide necessary information and cooperation for effective service delivery.
   • Respect intellectual property rights of FOTADE and third parties.
   • Refrain from abusive, misleading, or fraudulent behaviour when dealing with our teams or platforms.
7. Intellectual Property

   All materials, content, methodologies and deliverables provided by FOTADE Group remain the intellectual property of FOTADE unless otherwise agreed. Unauthorized use, reproduction or distribution is strictly prohibited.

8. Limitation of Liability

   FOTADE Group and its subsidiaries shall not be held liable for:

   • Indirect, incidental or consequential damages;
   • Delays or disruptions beyond reasonable control;
   • Third-party service failures (e.g., airlines, visa agencies, platform providers).
9. Confidentiality

   All client information and project details shall be treated as confidential unless disclosure is required by law or expressly permitted in writing by the client.

10. Amendments

    FOTADE Group reserves the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.

11. Governing Law

    These Terms are governed by and construed in accordance with the laws of Republic of South Africa. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in the Republic of South Africa.
